TERMS OF SERVICE
Thanks for choosing Project Stream Team (“Project Stream Team,” “we,” “us,” “our”). By signing up to or otherwise using the Project Stream Team platform, app, service, websites, and software applications (together, the “Service”), you are entering into a binding contract with Project Stream Team or Battle Creek Entertainment LLC. Project Stream Team provides personalized services with social and interactive features for streaming music and other content as well as other products and services that may be developed from time to time.
In order to access and use the Project Stream Team Service, you need to be at least 18 years old and have the power to enter a binding contract with us and not be prevented from doing so under any law. If you are under 18, you must be able to provide proof of your guardian’s consent. You also promise that the information you submit to us is true, accurate and complete, and you agree to keep it that way at all times.
If you open an account on behalf of a company, organization, or other entity, then (a) "you" includes you and that entity, and (b) you represent and warrant that you are authorized to grant all permissions and licenses provided in the Agreements and bind the entity to the Agreements, and that you agree to the Agreements on the entity's behalf.
Changes to the Agreements
Occasionally we may make changes to the Agreements. When we make material changes to the Agreements, we’ll provide you with notice as appropriate under the circumstance. In some cases, we will notify you in advance, and your continued use of the Service after the changes have been made will constitute your acceptance of the changes. Please therefore make sure you read any such notice carefully. At any point and without written warning, we may also at our discretion altar the speed of delivery that may or will conflict with the scheduled delivery of your order for the safe keeping of the customer's digital property. If you do not wish to continue using the Service under the new version of the Agreements, you may terminate your account by contacting us.
The Project Stream Team Service may be used and accessed solely for lawful purposes. You agree to abide by all applicable laws and regulations in connection with your use of the Service. This service will only be used for promotional purposes for your music on Spotify, SoundCloud, TIDAL, Apple Music, YouTube and or direct from our website or social media.
By purchasing from Project Steam Team, the customer is not to purchase from our web store for any monetary gain or any form of income. but rather for entertainment purposes only. You agree and warrant that you will not use the Project Stream Team Service to transmit, distribute, route, provide connections to or store any material that infringes copyrighted works or otherwise violates or promotes the violation of the intellectual property rights of any third party. You also agree not to produce streams yourself, engage with any other marketing firm or promotional team to produce any streaming activity to not confuse the purchase you have placed with another promotional company.
Your Project Stream Team Account shall be used solely by you and may not be transferred or shared with any third-party. You acknowledge that you are exclusively responsible for all usage or activity on your Project Stream Team Account. You shall immediately notify Project Stream Team of any breach of security or unauthorized use of your Project Stream Team account. Any fraudulent, abusive, or otherwise illegal account activity, including manipulated streams, shall constitute a basis to terminate your account. You agree to indemnify Project Stream Team against any liability and costs arising from such improper use of your Project Stream Team Account.
Project Stream Team Account
In order to access certain features of the Service, you must create and/or sign into a user account (“Project Stream Team Account”) of your own. Creating an account is completely free. Use of another’s account is not permitted. When creating your Project Stream Team Account, you must provide accurate and complete information.
You are solely responsible for the activity that occurs on your Project Stream Team Account. You are also responsible for maintaining the security of your account password, as well as the passwords of any third-party services that you may have elected to link to your account.
We will always make a reasonable effort in ensuring that our Services are available. Should the Services be interrupted in any way, we will make a reasonable effort to correct the interruptions without delay. We are, however, not liable for any errors, delays or interruptions that might occur.
Delivery and Streams
Slow delivery does not mean you will get a refund. Down time often occurs due to either maintenance, unforeseen circumstances or server updates on the streaming platform's end, not ours. There's no work around when such occurrences take place. Bigger packages, please allow 120+ days to fulfill.
If the customer delivers "Copy/Paste" an incorrect link with their purchase in the seller instructions field, and we process the incorrect link delivered to us, that processed order is considered fulfilled and final.
The number of streams you purchase for "Spotify Plays" is guaranteed. If not received in full, contact our customer care. We are happy to help.
For play packages, you may be issued up to 3 campaign updates by Project Stream Team in form of screenshot or written text via email. This applies per order.
To be eligible for SoundCloud royalties, you must have your SoundCloud account properly set up and monetized. See SoundCloud FAQ's for additional information. If your account is not set up properly, you hold Project Stream Team harmless in the event your plays do not produce royalties.
SoundCloud monetized plays are typically 90% monetized. Some countries we simply cannot filter out, so there will be just about a 10% ratio of non-monetized countries in your order.
Spotify Daily plays may deliver in full before 30 days. We try our best to delivery over a consistent daily period, but sometimes the delivery is out of our control.
Tik Tok Plays are delivered within a 24-hour time frame. Once a purchase has been placed, the customer has 12 hours to request a cancellation and refund, or before we have processed order, after which all sales related to Tik Tok Plays are final and non-refundable.
Any custom offer or proposal issued to a customer off site is still subject to all terms and conditions listed here at www.projectstreamteam.com
Any proposal or custom offer that has not been agreed upon, signed and executed within 30 days of issuance is considered a terminated proposal.
Instagram & Twitter: Customers may experience what is called a 'drop off' of actions like followers, likes, reposts and comments. We cannot control human behavior. For 30 days, we will initiate refills of any lost drop offs, after which the campaign has completed processing in full. All sales are final after the order has begun processing. You may request a refund if we haven't initiated your campaign yet. By purchasing from Project Stream Team, you the customer agree to these terms.
Tidal: When purchasing a Tidal package from Project Stream Team, you the customer acknowledge that the Tidal streaming platform performs a vast auditing process of the streams they receive, making it longer than normal wait times to receive the issue of analytics and royalties from a campaign. Most cases are within six to nine (6-9) months; however, we have experienced some cases to be up to a thirteen month wait period. This process has nothing to do with Project Stream Team, and you the customer agree that in no way will you engage in a chargeback with your bank over a Tidal package purchased with our site.
Term of Interruption: In the event a customer electively removes or has their music removed from the streaming platforms, under no circumstance will there be a continuation of the order purchased or refund given as that order would then be marked as complete for breaking this term of interruption.
A reseller is a company or individual that purchases goods or services with the intention of selling them rather than consuming or using them. This is usually done for profit. In full transparency, Project Stream Team resells up to 90% of our product inventory.
Sellers Instructions: In accordance with the terms set on the 'Spotify Plays, Apple Music, Napster, SoundCloud and Audiomack' page, any purchase made with under 100k plays, if an "Album URL" is specified in the seller’s instructions notes, automatically the first track from the album will be serviced. If you wish to have any plays package under 100k serviced for a particular song, please specify that Track URL in the Sellers Instruction field before checking out. We apologize for this inconvenience however we get too many daily orders to organize order notes with each individual the customer.
Sellers Instructions: In the event a customer does not supply a Track, Video or any required URL for their respective purchases, a customer service rep will contact the customer up to three times. If communication is not met, we will mark the order as complete. As soon as the customer establishes contact, we will honor the purchase made and process the link provided.
The customer may change the URL of their track within written notice 24 hours prior to subscription renewal. Anything beyond this period will have the same URL processed for the following month.
The terms of this Agreement shall commence and continue (the “Term”) unless terminated by either Party under the Agreements.
Breach of Subscription
A customer may terminate a subscription after the minimum of three subscripiton cycles (months) has elapsed. If a customer is within breach of service, all losses may be recouped by Project Stream Team.
Project Stream Team may terminate the Agreements or suspend your access to the platform at any time for any and no reason, including in the event of your actual or suspected unauthorized use of the Project Stream Team Service and/or any content, or non-compliance with the Agreements. You may terminate your Project Stream Team Account at any time by submitting a termination request to Customer Support.
Termination of Subscription - When a customer electively cancels a subscription and or requests a Project Stream Team agent to cancel a subscription, that subscription and service associated with subscription is immediately terminated upon notice of cancellation/termination.
Skipped Shipment - When a customer electively "Skips Shipment", you grant Project Stream Team the right to automatically pause your subscription. Subscriptions will resume as normal once the customer has renewed their shipment dates, or payment dates.
First, Second and Final Attempt - At checkout is the "Sellers Instructions" field. This is where the customer is prompted to paste their respective track URL for their order. In the event the customer misses this step, Project Stream Team will send three emails to the customer to retrieve this information. In the unlikely event the customer does not respond to a single email, the store is granted permission by these terms to mark the order as "Complete." Project Stream Team will honor the purchase placed the moment the customer gets our team the needed information to process their purchase.
Parallel Promotions - It is strictly prohibited to purchase and enlist in promotional services from Project Stream Team while hiring outside marketing/promotions teams to work the same project (i.e song, track, video etc.)
You agree that upon purchasing any "Plays" (Stream) song and other promotions from us, you clearly understand and agree what you are purchasing via PayPal, Credit Card, Or Financial Institution.
No Partial or Full Refunds will be issued for service interruption (maintenance periods) failure or anything else unless your order simply does not get delivered at all.
Subscriptions: When a customer purchases any subscription other than Radio Airplay, they agree to subscribe to a minimum of 3 months before cancelling their recurring service.
Project Stream Team may change the price for the Paid Subscriptions, including recurring subscription fees from time to time and will communicate any price changes to you in advance and, if applicable, how to accept those changes. Price changes will take effect at the start of the next subscription period following the date of the price change. Subject to applicable law, you accept the new price by continuing to use the Project Stream Team Service after the price change takes effect. If you do not agree with a price change, you have the right to reject the change by unsubscribing from the Paid Subscription prior to the price change going into effect.
Cancellations & Refunds may be issued up until your order has begun to process. Any time beyond this window is considered an active order or subscription and no refund will be issued.
In no way can project stream team guarantee the customer will receive royalties from any package purchased from our store. Our services are for entertainment only. Under no circumstance will the customer pursue a chargeback for a lack of royalties received. Purchase responsibly.
All discounted purchases or *promotions are FINAL SALE and non-refundable. The Terms & Conditions listed here on this website uphold all transactions made here and off-site Project Stream Team transactions and deals. All discount sales are final and non-refundable.
Project Stream Team does not allow RESELLERS, and resale is strictly forbidden. In no way will refunds be issued to resellers.
Custom Orders are final and non-refundable.
No refunds will be issued for not receiving any royalties within a calendar year with On Air - Radio Airplay subscription, as royalties take from 18-24 'mailbox money' months to receive via your PRO i.e ASCAP, BMI etc...
In the event of unforeseeable yet potential negative outcomes with an order placed on www.projectstreamteam.com, I.e drop is streams, followers, the banning or removal of their content from streaming platforms, the customer agrees to forego chargebacks and will not engage in litigious efforts to recoup fees for works executed by Project Stream Team.
Rights you grant us
In consideration for the rights granted to you under the Agreements, you grant us the right (1) to allow the Project Stream Team Service to use the processor, bandwidth, and storage hardware on your Device in order to facilitate the operation of the Service, (2) to provide advertising and other information to you, and (3) to allow our business partners to do the same. In any part of the Project Stream Team Service, the Content you access, including its selection and placement, may be influenced by commercial considerations, including Project Stream Team’s agreements with third parties. Some Content licensed by, provided to, created by or otherwise made available by Project Stream Team may contain advertising as part of the Content. The Project Stream Team Service makes such Content available to you unmodified.
If you provide feedback, ideas or suggestions to Project Stream Team in connection with the Project Stream Team Service or Content (“Feedback”), you acknowledge that the Feedback is not confidential and you authorize Project Stream Team to use that Feedback without restriction and without payment to you. Feedback is considered a type of User Content.
You grant Project Stream Team a non-exclusive, transferable, sub-licensable, royalty-free, perpetual, irrevocable, fully paid, worldwide license to use, reproduce, make available to the public (e.g. perform or display), publish, translate, modify, create derivative works from, and distribute any of your User Content in connection with the Service through any medium, whether alone or in combination with other Content or materials, in any manner and by any means, method or technology, whether now known or hereafter created. Aside from the rights specifically granted herein, you retain ownership of all rights, including intellectual property rights, in the User Content. Where applicable and permitted under applicable law, you also agree to waive and not enforce any “moral rights” or equivalent rights, such as your right to be identified as the author of any User Content, including Feedback, and your right to object to derogatory treatment of such User Content.
Project Stream Team respects intellectual property rights and expects you to do the same.
The following is not permitted for any reason whatsoever:
- copying, redistributing, reproducing, “ripping,” recording, transferring, performing or displaying to the public, broadcasting, or making available to the public any part of the Project Stream Team Service or the Content, or otherwise making any use of the Project Stream Team Service or the Content which is not expressly permitted under the Agreements or applicable law or which otherwise infringes the intellectual property rights (such as copyright) in the Project Stream Team Service or the Content or any part of it;
- transferring copies of cached Content from an authorized Device to any other Device via any means;
- reverse-engineering, decompiling, disassembling, modifying, or creating derivative works of the Project Stream Team Service, Content or any part thereof except to the extent permitted by applicable law;
- circumventing any technology used by Project Stream Team, its licensors, or any third party to protect the Content or the Service;
- selling, renting, sub-licensing or leasing of any part of the Project Stream Team Service or the Content;
- circumventing any territorial restrictions applied by Project Stream Team or its licensors;
- removing or altering any copyright, trademark, or other intellectual property notices contained on the Content or the Service or provided through the Service (including for the purpose of disguising or changing any indications of the ownership or source of any Content);
- circumventing or blocking advertisements in the Project Stream Team Service, or creating or distributing tools designed to block advertisements in the Project Stream Team Service;
- providing your password to any other person or using any other person’s username and password;
- “crawling” the Project Stream Team Service or otherwise using any automated means (including bots, scrapers, and spiders) to view, access or collect information from Project Stream Team Service;
- selling a user account, or otherwise accepting or offering to accept any compensation, financial or otherwise, to influence the name of an account or playlist or the content included on an account or playlist; or
- artificially promoting Content by automated means or otherwise.
Don’t engage in any activity, post any User Content, or register and/or use a username, which is or includes material that:
- is offensive, abusive, defamatory, pornographic, threatening, or obscene;
- is illegal, or intended to promote or commit an illegal act of any kind, including violations of intellectual property rights, privacy rights, or proprietary rights of Project Stream Team or a third party;
- includes your password or purposely includes any other user’s password or purposely includes personal data of third parties or is intended to solicit such personal data;
- includes malicious content such as malware, Trojan horses, or viruses, or otherwise interferes with any user’s access to the Service;
- is intended to or does harass or bully other users;
- impersonates or misrepresents your affiliation with another user, person, or entity, or is otherwise fraudulent, false, deceptive, or misleading;
- involves the transmission of unsolicited mass mailings or other forms of spam, junk mail, chain letters, or similar;
- involves commercial or sales activities, such as advertising, promotions, contests, sweepstakes, or pyramid schemes, that are not expressly authorized by Project Stream Team;
- links to, references, or otherwise promotes commercial products or services, except as expressly authorized by Project Stream Team;
- interferes with or in any way disrupts the Project Stream Team Service, tampers with, breaches, or attempts to probe, scan, or test for vulnerabilities in the Service or Project Stream Team’s computer systems, network, usage rules, or any of Project Stream Team’s security components, authentication measures or any other protection measures applicable to the Service, the Content or any part thereof; or
- conflicts with the Agreements, as determined by Project Stream Team.
You acknowledge and agree that posting any User Content that violates these User guidelines (or that Project Stream Team reasonably believes violates these User guidelines) may result in immediate termination or suspension of your Project Stream Team account.
Project Stream Team Services includes social and interactive features, including the ability to post User Content, share content, and make certain information about you public. Remember that shared or publicly available information may be used and re-shared by other users on Project Stream Team or across the web, so please use Project Stream Team carefully and be mindful of your account settings. Project Stream Team has no responsibility for your choices to post material on the Service.
All products found on Project Stream Team are listed as entertainment value, and not to be purchased as a primary or secondary source of income. Please purchase responsibly.
Project Stream Team will not be responsible for any damages you or your business may suffer. Since Project Stream Team uses the internet to deliver services, we cannot guarantee up time or availability of our website.
Royalties: Project Stream Team does not in any way distribute royalties, nor do we have any control over when royalties are sent out via your distribution service. Project Stream Team only produces plays via methods such as play-listing.
Third Party Applications
The Project Stream Team Service may be integrated with third party applications, websites, and services (“Third Party Applications”) to make the Services available to you. These Third-Party Applications may have their own terms and conditions and privacy policies and your use of these Third-Party Applications will be governed by and subject to such terms and conditions and privacy policies. You understand and agree that Project Stream Team does not endorse and is not responsible or liable for the behavior, features, or content of any Third-Party Application or for any transaction you may enter into with the provider of any such Third-Party Applications.
YOU UNDERSTAND AND AGREE THAT THE PROJECT STREAM TEAM SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT EXPRESS OR IMPLIED WARRANTY OR CONDITION OF ANY KIND. PROJECT STREAM TEAM AND ALL OWNERS OF THE CONTENT MAKE NO REPRESENTATIONS AND DISCLAIM ANY WARRANTIES OR CONDITIONS OF SATISFACTORY QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. NEITHER PROJECT STREAM TEAM NOR ANY OWNER OF CONTENT WARRANTS THAT THE PROJECT STREAM TEAM SERVICE IS FREE OF MALWARE OR OTHER HARMFUL COMPONENTS. IN ADDITION, PROJECT STREAM TEAM MAKES NO REPRESENTATION NOR DOES IT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY THIRD PARTY APPLICATIONS (OR THE CONTENT THEREOF), USER CONTENT, DEVICES OR ANY OTHER PRODUCT OR SERVICE ADVERTISED, PROMOTED OR OFFERED BY A THIRD PARTY ON OR THROUGH THE PROJECT STREAM TEAM SERVICE OR ANY HYPERLINKED WEBSITE, OR FEATURED IN ANY BANNER OR OTHER ADVERTISING AND PROJECT STREAM TEAM IS NOT RESPONSIBLE OR LIABLE FOR ANY TRANSACTION BETWEEN YOU AND THIRD PARTY PROVIDERS OF THE FOREGOING. NO ADVICE OR INFORMATION WHETHER ORAL OR IN WRITING OBTAINED BY YOU FROM PROJECT STREAM TEAM SHALL CREATE ANY WARRANTY ON BEHALF OF PROJECT STREAM TEAM. WHILE USING THE PROJECT STREAM TEAM SERVICE, YOU MAY HAVE ACCESS TO EXPLICIT CONTENT FILTERING FEATURES, BUT USE OF THESE FEATURES MAY STILL RESULT IN SOME EXPLICIT CONTENT BEING SERVED AND YOU SHOULD NOT RELY ON SUCH FEATURES TO FILTER ALL EXPLICIT CONTENT. THIS SECTION APPLIES TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
THIS SECTION DOES NOT AFFECT YOUR STATUTORY RIGHTS AS A CONSUMER.
Limitation of Liability
YOU AGREE THAT, TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY PROBLEMS OR DISSATISFACTION WITH THE PROJECT STREAM TEAM SERVICE IS TO UNINSTALL ANY PROJECT STREAM TEAM SOFTWARE AND TO STOP USING THE PROJECT STREAM TEAM SERVICE.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL PROJECT STREAM TEAM, ITS OFFICERS, SHAREHOLDERS, EMPLOYEES, AGENTS, DIRECTORS, SUBSIDIARIES, AFFILIATES, SUCCESSORS, ASSIGNS, SUPPLIERS, OR LICENSORS BE LIABLE FOR (1) ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES; (2) ANY LOSS OF USE, DATA, BUSINESS, OR PROFITS (WHETHER DIRECT OR INDIRECT), IN ALL CASES ARISING OUT OF THE USE OR INABILITY TO USE THE PROJECT STREAM TEAM SERVICE, REGARDLESS OF LEGAL THEORY, WITHOUT REGARD TO WHETHER PROJECT STREAM TEAM HAS BEEN WARNED OF THE POSSIBILITY OF THOSE DAMAGES, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE; OR (3) AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE PROJECT STREAM TEAM SERVICE, THIRD PARTY APPLICATIONS, OR THIRD PARTY APPLICATION CONTENT MORE THAN $1,000 (one-thousand USD), TO THE EXTENT PERMISSIBLE BY APPLICABLE LAW.
YOU SHALL INDEMNIFY AND HOLD HARMLESS PROJECT STREAM TEAM, ITS SUBSIDIARIES AND AFFILIATES (INCLUDING ANY DIRECTORS, MEMBERS, EMPLOYEES, MEMBERS AND OTHER REPRESENTATIVES) AND THE STORES FROM AND AGAINST ANY AND ALL CLAIMS, LOSSES, DAMAGES, LIABILITIES, COSTS AND EXPENSES INCLUDING, WITHOUT LIMITATION, LEGAL EXPENSES AND COUNSEL FEES, ARISING OUT OF ANY BREACH OR ALLEGED BREACH BY YOU OF THE ABOVE WARRANTIES AND REPRESENTATIONS AND/OR USE OF THE RECORDINGS OR MATERIALS AS PERMITTED HEREUNDER.
Other than as stated in this section or as explicitly agreed upon in writing between you and Project Stream Team, the Agreements constitute all the terms and conditions agreed upon between you and Project Stream Team and supersede any prior agreements in relation to the subject matter of these Agreements, whether written or oral.
Severability and Waiver
Unless as otherwise stated in the Agreements, should any provision of the Agreements be held invalid or unenforceable for any reason or to any extent, such invalidity or unenforceability shall not in any manner affect or render invalid or unenforceable the remaining provisions of the Agreements, and the application of that provision shall be enforced to the extent permitted by law. Any failure by Project Stream Team to enforce the Agreements or any provision thereof shall not waive Project Stream Team’s or the applicable third-party beneficiary’s right to do so.
Project Stream Team may assign the Agreements or any part of them, and Project Stream Team may delegate any of its obligations under the Agreements. You may not assign the Agreements or any part of them, nor transfer or sub-license your rights under the Agreements, to any third party.
To the fullest extent permitted by applicable law, you agree to indemnify and hold Project Stream Team harmless from and against all damages, losses, and expenses of any kind (including reasonable attorney fees and costs) arising out of: (1) your breach of this Agreement; (2) any content submitted by you to the Service; (3) any activity in which you engage on or through the Project Stream Team Service; and (4) your violation of any law or the rights of a third party.
Project Stream Team takes no liability or responsibility for failures in providing any of our Services, if they are caused by an event outside Project Stream Team’s control. Force Majeure means an event beyond our control which prevents us from complying with any obligations under this Agreement. These events include, but are not limited to, fires, earthquakes, tidal waves, floods, war, hostilities, invasion, embargo, revolution, civil war, riot, strikes, lockouts, acts or threats of terrorism, commotion, failures of public or private telecommunication networks, third party force majeure and an epidemic.
Should an event of Force Majeure occur, Project Stream Team will notify you as soon as reasonable and give an estimate when due fulfilment can be expected. You may cancel your Services with us if your Service is affected by Force Majeure.
JURISDICTION AND DISPUTE VENUE
The Agreements and our Services shall be governed by the laws of California state and any dispute regarding this Agreement shall be submitted to the exclusive jurisdiction of the Courts of Los Angeles County, California.
